US Supreme Court Blocks Emergency Tariffs — How Will Trump’s 10% Levy Impact India?

Описание: The United States Supreme Court has struck down tariffs imposed under emergency powers, forcing the Trump administration to quickly redesign its trade strategy. The ruling invalidated duties introduced under the International Emergency Economic Powers Act (IEEPA), creating uncertainty around multiple trade arrangements negotiated under those provisions.

In response, President Donald Trump signed executive orders introducing a temporary 10% global tariff under Section 122 of the Trade Act of 1974. This rarely used provision allows the US president to impose duties for up to 150 days without prior investigations. The move replaces earlier emergency tariffs that ranged between 10% and 50%.

For India, the development means another recalibration of export duties to the US. Indian goods now revert to most-favoured-nation (MFN) levels, layered with the temporary 10% global tariff. However, exemptions for sectors such as mobile phones and pharmaceuticals are expected to continue, while national security tariffs on steel and automobiles remain in force.

Despite the legal setback, Trump has maintained that the India-US trade deal remains intact, though it will now proceed under alternative legal frameworks such as Section 301 and Section 232 investigations.
