Federal Judge Warns State and Federal Officials Over Immigration Detentions

A federal judge in West Virginia has issued a sharp warning to state and federal officials over immigration detentions that he says violate the Constitution.
In this case, a Honduran national was detained without a criminal charge and without an individualized custody hearing before a neutral decisionmaker. Multiple federal judges in West Virginia had already ruled that this type of detention violates the Fifth Amendment Due Process Clause. Despite those rulings, the practice continued.
Chief U.S. District Judge Joseph Goodwin ordered the detainee’s immediate release and wrote:
“The Constitution does not contemplate violations in installments.”
He went further, warning that if the practice continues, the court will use its full authority, including injunctions, sanctions, and contempt proceedings, against officials who continue detentions in defiance of the court’s rulings.
