آرڈر IX، قاعدہ 13 — یکطرفہ ڈگری و فیصلہ — یکطرفہ ڈگری کو کالعدم قرار دینے کی درخواست کی مستردی —
مرحلۂ شہادت کے دوران درخواست گزار/مدعا علیہ عدالت میں پیش ہونا ترک کر گیا، جس کے نتیجہ میں عدالتِ نے اس کے خلاف یکطرفہ کارروائی کرتے ہوئے مدعی کے حق میں فیصلہ اور ڈگری صادر کر دی۔
بعد ازاں درخواست گزار نے آرڈر IX قاعدہ 13 سی پی سی کے تحت یکطرفہ ڈگری کے اخراج (set aside) کے لیے درخواست دائر کی، مؤقف اختیار کیا کہ فریقین کے مابین مفاہمت (compromise) کی کوشش جاری تھی اور مدعی نے اسے بتایا تھا کہ دعویٰ واپس لے لیا گیا ہے، جس تاثر کی بنا پر وہ کارروائی میں پیش نہ ہوا۔
عدالتِ عالیہ نے قرار دیا کہ درخواست گزار نے اپنی درخواست کے ہمراہ کوئی تحریری صلح نامہ منسلک نہیں کیا، نہ ہی مبینہ مفاہمت کی شرائط و قیود، تاریخ، وقت اور مقام یا ان اشخاص کی تفصیل بیان کی جن کے روبرو یہ مفاہمت طے پائی۔ مزید برآں، درخواست میں یہ بھی مذکور نہیں کہ اس نے اپنے وکیل کو اس مبینہ مفاہمت سے آگاہ کیا یا اسے عدالت میں پیش نہ ہونے کی ہدایت دی۔ نیز یہ بھی واضح نہیں کیا گیا کہ اس نے دعویٰ کی واپسی کی تصدیق اپنے وکیل یا عدالت سے کیوں نہ کی۔
یہ تمام حالات اس امر کی غمازی کرتے ہیں کہ درخواست گزار نے دانستہ طور پر عدالتی کارروائی میں عدم شرکت اختیار کی اور عدالت کے ساتھ عدم تعاون کا مظاہرہ کیا، لہٰذا وہ اس بات کا مستحق نہیں کہ عدالت سے رعایت طلب کرے اور یکطرفہ ڈگری کو کالعدم قرار دلوائے۔
لہٰذا اس کی درخواست ضروری مادی حقائق سے عاری، مبہم اور غیر معین ہونے کی بنا پر ابتدائی مرحلہ پر ہی مسترد کیے جانے کے قابل تھی، اور یہ اس کی اپنی غفلت و کوتاہی کو چھپانے کی ایک کوشش معلوم ہوتی ہے۔ درخواست گزار کو اپنی ہی غلطی یا لاپرواہی سے فائدہ اٹھانے کی اجازت نہیں دی جا سکتی۔
چنانچہ اجازت برائے اپیل کی درخواست مسترد کی جاتی ہے اور اجازت دینے سے انکار کیا جاتا ہے۔

Civil Procedure Code ( V of 1908 ) ---
--- O . IX , R. 13 -- Ex - parte decree and judgment -- Application for setting aside ex - parte.decree and judgment , dismissal of At the stage of recording the evidence , the petitioner - defendant stopped appearing, and thus , the Trial Court proceeded ex - parte against him and subsequently , by its judgment issued a decree in favour of the respondent - plaintiff -- Petitioner applied under Order IX , Rule 13 , C.P.C. to set aside the ex - parte decree taking the stance that there was an attempt to compromise between the parties and he was told by the respondent that the suit had been withdrawn and under this impression , he did not appear in the proceedings -- Held that petitioner did not attach any compromise deed with his application ( under Order IX , Rule 13 , C.P.C. ) nor did he mention the details of the terms and conditions of the alleged compromise in his application nor the date, time and name of the persons before whom it was made -- Secondly, he also did not mention in his application that he had told his counsel about the alleged compromise and instructed him not to appear before the Court , and thirdly he had not disclosed any reason as to why he did not take any step to confirm the fact of withdrawal of suit from his counsel -- All such facts showed that the petitioner had deliberately chosen to refrain from joining the proceedings and displayed non cooperation with the Court and therefore, he had no right to ask its indulgence and seek setting aside of ex - parte decree passed against him -- As such , his application deserved a summary dismissal as it was deficient in necessary material facts , and was vague in all respects , and appeared to be an attempt to cover up his misdeeds and negligence -- Petitioner could not be allowed to take advantage of his own wrong or negligence ---

Petition for leave to appeal was dismissed and leave was refused.
