SUMMARY:- The Supreme Court has reaffirmed that arbitration clauses in agreements cannot override a consumer's right to approach consumer forums for dispute resolution. A consumer cannot be compelled to undergo arbitration solely because of an arbitration clause in the contract. The Court emphasized that only the consumer has the exclusive choice to opt for arbitration or proceed with a consumer complaint.
In M/S Citicorp Finance (India) Ltd. v. Snehasis Nanda, the respondent had approached the NCDRC seeking payment from the appellant despite an arbitration clause in a tripartite agreement. The NCDRC ruled in favor of the respondent, and the Supreme Court upheld the consumer's right to bypass arbitration and seek redress through the Consumer Forum.
Citing precedents like Emaar MGF Land Ltd. v. Aftab Singh (2019) and M. Hemalatha Devi v. B. Udayasri (2024), the Court reiterated that consumer disputes are non-arbitrable unless the consumer voluntarily chooses arbitration. The decision reinforces that consumer rights under welfare legislation cannot be overridden by private arbitration agreements.
