By Appellant’s Notice, filed on 19 December 2022, the Appellant appeals the Order of Butcher J, sitting in the Business and Property Court dated 21 October 2022, summarily dismissing the Appellant’s application under s67 of the Arbitration Act 1996, and the subsequent costs order, dated 17 November 2022.
The Parties are involved in Arbitration proceedings arising out of a Gas Sale and Purchase Contract in which the Appellant agreed to supply the First Respondent who’s interest was subsequently assigned to the Second Respondent (Crescent Gas Corporation Ltd).
