On March 30, 2022, three documents were presented to the Utah County Recorders Office for filing on the Public Record, but were unlawfully removed from the County Recorder's office without our permission in what appears to be a criminal Theft and/or Destruction of Public Records.

As per Utah Code 57-3-104 - Certified copies entitled to record in another county - we are “ENTITLED” to do so. The law is clear. We, my wife Barbara and I laid our 3 docs down with the $40 on each and slide them across the counter, with the witness of four (4) deputy Sheriffs Evans, O’Hara, Bailey and Provstgaard, and left with the instructions to "File on Demand".

We finally received GRAMA Requested footage (audio and/or video) from the Sheriff’s Dept, and combining the Deputys' bodycam footage with our own, we created this video documenting the theft at... As we were leaving, Sheriff Deputy O’Hara said that we were "abandoning property”. I asked him for any law to back up his claim, but couldn’t provide it. He did not. He was warned that we would considered it theft if any Deputy Sheriffs removed our filings.

Previously Deputy Evans had declared that the Utah County Attorney's Office had instructed them to "obey two court orders". The instructions were erroneous. Their readings were clearly incorrect as, if they had any lawful application at all, ONLY referenced "land record" filings which these Salt Lake County Recorder office documents clearly were not. We do not believe their misunderstanding was innocent but rather an attempt to intimidate under color of law and ongoing conspiracy to deny us our rights.

The documents cost near $900 to get Certified Copies printed and were now stolen and/or destroyed Public Documents.

Luckily, it appears that we caught a picture of our docs are being stolen in the act while taking a selfie. Therefore, rather than intimidate us, they may instead some day have to testify in court against each other and address the potential criminal action documented on the video footage & selfie photo below we took outside the Recorder’s office after filing.

Deputy John O'Hara, Deputy Larry Evans, Mitchell Bailey, and Provstgaard, as captured on GRAMA requested bodycam footage, removed lawfully paid and lawfully filed documents with the Utah County Recorder, did so in direct defiance of Utah County policy and Utah State Code: "Provide certified copies of documents for a fee. These may be recorded in the office of any other County Recorder in the State. (Utah Codes 17-21-4, 57-3-104) AND an incorrect and erroneous reading of UN-related alledged Court orders, all of which is PUNISHABLE under "63G-2-804. Violation of provision of chapter -- Penalties for intentional mutilation or destruction -- Disciplinary action. A governmental entity may take disciplinary action which may include suspension or discharge against any employee of the governmental entity who intentionally violates any provision of this chapter..." WE WISH TO PRESS CHARGES. PLEASE CONFIRM AND ADVISE TO PROPER PROCESS.
