The Madurai Bench of the Madras High Court has upheld the order permitting the lighting of the sacred Karthigai Deepam at the Deepathoon on Thiruparankundram Hill, reinforcing the primacy of constitutional rights over politically driven objections. The court endorsed Justice G.R. Swaminathan’s earlier decision, making it clear that long-standing religious practices cannot be curtailed on the basis of speculative or unsubstantiated concerns. In a strong affirmation of the rule of law, the bench emphasized that administrative apprehensions must be grounded in real and demonstrable threats—not conjecture.
In sharp criticism of the Stalin-led DMK government, the Madras High Court dismissed the state’s claim that allowing the ritual would disturb law and order, calling it an “imaginary” narrative manufactured for political convenience. The bench observed that the government failed to present credible material to justify its apprehensions. By rejecting the state’s arguments, the court sent a clear message that governance cannot be guided by political agendas at the cost of religious freedom and established tradition, reaffirming judicial independence and constitutional balance.
