Big win for homebuyers! The Maharashtra Real Estate Appellate Tribunal (MREAT) has ruled that a registered Agreement for Sale is NOT mandatory to claim relief under RERA. In this landmark judgment dated December 19, 2025, buyers Krupa Samir Kapadia and Pooja Samir Kapadia successfully got their refund of ₹19.5 lakh with interest starting from the payment date (November 11, 2012) in the delayed "Lake Riveira" project by Siddhitech Homes Pvt. Ltd.
Key highlights:
Allotment letter + payment receipts = Valid contract under RERA (even pre-2016 bookings).
Interest at SBI Highest MCLR + 2% (currently ~10.80% based on latest rates effective Dec 15, 2025).
No need for formal registered sale agreement!
Project still incomplete after 13+ years – no OC yet.
