On September 22, 2024, an officer with the Owen-Withee Police Department initiated a traffic stop after observing a vehicle traveling 57 MPH in a posted 25 MPH zone—nearly double the speed limit, with children riding bicycles along the roadside.

The driver, identified as Elizabeth, was unable to locate her driver’s license and appeared visibly emotional. While speaking with her, the officer detected the odor of intoxicants coming from the vehicle and noticed a pill bottle on the passenger seat, which Elizabeth claimed was a prescription.

While attempting to identify herself, Elizabeth produced her birth certificate and Social Security card instead of a license. The officer confirmed her identity and discovered that she had four prior OWI convictions, a revoked driving status, and was subject to a .02 BAC restriction.

Elizabeth displayed multiple signs of impairment and was asked to step out of the vehicle. After a brief emotional pause, she agreed to perform field sobriety tests, which she ultimately failed. When asked how much she had been drinking, Elizabeth responded, “Not enough.” She later refused to provide a preliminary breath sample.

Elizabeth was placed under arrest. Before being handcuffed, she requested and was allowed to smoke a cigarette. While waiting by the squad car, she became increasingly upset and stated that she believed she was going to prison.

A K9 unit conducted a sniff around the vehicle but did not alert. Elizabeth was read the Informing the Accused form, after which she became verbally upset. She later agreed to a blood draw, which was conducted at a local hospital before she was transported to the Clark County Jail.

Blood test results later revealed a BAC of .197. Elizabeth was convicted of Operating with a Prohibited Alcohol Concentration (5th offense) and sentenced to 18 months in prison along with 5 years of extended supervision.
