Traditionally, 730 days of childcare leave has been granted only to female government employees in West Bengal. However, when a single father moved court demanding the same benefit, the discussion of gender equality in parenting came into sharp focus.

The case was heard in the courtroom of Justice Amrita Sinha, who observed that childcare should not be seen as only a mother’s responsibility. Fathers, especially single fathers, must also have equal rights to care for their children.

The State Government opposed the plea, arguing that since male employees far outnumber women in the workforce, granting such leave to men would cause administrative disruption and impact developmental projects. They also noted that while the Central Government provides limited paternity leave, there is no policy granting men long-term childcare leave.

After reviewing arguments, the High Court dismissed the contempt plea but made an important humanitarian exception. The petitioner (a single father) has been asked to apply directly to the Principal Secretary of the School Education Department, who must take a decision within two weeks, considering his personal circumstances.

This ruling highlights both sides of the debate—administrative challenges vs. human rights and gender equality. While the larger policy remains unchanged, the verdict is being seen as a first step toward future reforms, where men may also be granted equal rights in childcare leave.

The case has sparked wider discussions in society. Many believe this could pave the way for new policies that acknowledge the evolving role of fathers in parenting.
