In this episode, host Tapas Kanti Baul sits down with Senior Advocate Tania Amir to unpack one of the most consequential constitutional debates in Bangladesh’s recent history.
Following the February 2026 elections, Bangladesh faces an intense standoff sparked by the July National Charter, a reform document endorsed through a referendum but now at the center of political and legal contestation.
A major flashpoint has emerged between the Bangladesh Nationalist Party (BNP) and Jamaat‑e‑Islami: BNP MPs have refused to take the second oath tied to the July Charter, asserting allegiance only to the Constitution, Jamaat‑e‑Islami MPs took both oaths, embracing the Charter’s reform mechanism, and this has triggered boycotts, threats of protest, and heightened parliamentary friction.
Meanwhile, the High Court Division has issued a rule nisi, asking the government to explain why the Charter, the Referendum Ordinance, and related oath procedures should not be declared unconstitutional.
In this 30‑minute conversation, we explore:
🟦 Can the July Charter legally override the Constitution?
🟦 What is the constitutional significance of the dual‑oath controversy?
🟦 What do the writ petitions and the High Court’s rule suggest about the Charter’s fate?
🟦 How might these tensions reshape Parliament and the reform process?
If you care about constitutional law, democracy, and political reform in South Asia, this episode offers essential insights.
