Still Game star Ford Kiernan wins legal battle over £1m former Glasgow home

Описание: Still Game star Ford Kiernan has won a legal battle after a roof repair row at his former £1m home.   The TV funnyman, 58, and wife Lesley were sued by Stephen and Claudia McCann.   The McCanns had bought the Kiernans luxury flat in Glasgow's Kelvinside in July 2017.  But, the McCanns later complained they were left with a £105,000 bill for work at the B-listed building.  They claimed "substantial common repairs" had apparently been instructed by residents there before the pair moved in.  The Kiernans argued they were not aware of any planned improvements prior to selling.  The row was the subject of a civil hearing at Glasgow Sheriff Court.  The McCanns lost the cash battle - and an appeal against the decision was today thrown out.  The McCanns paid £950,000 for the property. The Kiernans had originally paid just over £1m.  Paperwork for the case stated the buyers then "discovered substantial common repairs including substantial roof repairs" had been instructed by owners of other properties in the building.  This also included "stone replacement" and "garden work".  It was said a firm was ordered to carry out a building report in May 2016.  Ford Kiernan was said to have been at a later meeting about the proposed work.  The estimated cost for the repairs was stated to be £396,000.  Each resident was liable to pay their share of the work.  In the court papers, the McCanns lawyers claimed: "A majority of three out of the four owners had decided to proceed with the works identified.  "The defenders (Kiernans) were bound by the votes by the other proprietors whether they consented to them or not.  "The pursuers (McCanns) became liable for the works which the defenders failed to disclose."  It was also stated attempts for grants - including to the Glasgow City Heritage Trust - had been made by residents to help with the costs.  Ford Kiernan was said to have been asked by another owner to put his name to an application.  It was stated: "The (Kiernans) were sent a mandate which they did not sign."  The paperwork alleged the Kiernans did "wholly ignore" certain clauses relevant to the house sale.  The McCanns - who delayed moving to the property due to working abroad - were suing for a total of £105,959.  It was alleged: "Despite repeated requests...the defenders refuse or delay to make payment."  The papers said had the McCanns known about any proposed repairs they would have "sought an appropriate price reduction" or decided not to buy at all.  But, the Chewin the Fat star and his wife insisted "no works were instructed" prior to the sale of their house.  The court document read: "They were never informed of any proposal to instruct works in the absence of grant funding, nor did they agree such instruction.  "Had they been, they would not have consented to them as they were marketing the property for sale.  "They were unaware that any works were contemplated in the absence of grant funding."  They argued the claims were "irrelevant" and "lac
