Children and IEPs move together. What will happen to my child’s IEP if we transfer to a new school?
Whether you and your family are moving for a new job, a Permanent Change of Station or simply a chance for a new beginning, parents need to know that their child’s IEP will follow them whether they move to another public school within the same district, to another public district within the same state, or to another state entirely to attend a public school.
Parents’ main concerns tend to gravitate around the questions: Will my child receive the same services? Or will the new school offer services that fit my child’s needs?
As stated in federal rules IDEA 2004 20 US § 1414 (d) (2) (C); 34 CFR § 300.323 (e), (f) and (g); and Texas Administrative Code § 89.1050, children with disabilities that transfer to another school are entitled to FAPE, including services comparable to those described in their previous IEP. An evaluation could be necessary, but parents will be consulted and special education services, accommodations and modifications will be provided until a new IEP is developed.
The keyword is COMPARABLE. According to the Department of Education, this means SIMILAR or EQUIVALENT services to the ones your child received in their previous IEP.
Moving and transferring IEP’s should not be a burden, but due to the differences in state regulations across the country, this issue tends to put parents at a crossroads between the excitement of the move to a new location and the concern to maintain consistency and stability in services for their child. This is especially true for military, migrant and foster families.
Having all your child’s academic and health records updated and organized, gives you an important advantage in preventing any delay in the provision of services to your child.
