Amjed Ullah Khan, Spokesman of MBT, has strongly urged the Government of Telangana to immediately approach the Hon’ble High Court and seek appropriate relief/clarification to ensure that Muslims are allowed to offer Eid Namaz at the Eidgah in Bhongir, Yadadri Bhuvanagiri District.
Mr. Khan stated that the land in Survey No. 902, admeasuring Ac. 3.23 guntas, belongs to Dargah Hazrat Raja Bagh Sawar and Masjid-e-Faqeer Takhiya, and is a registered Wakf property. He explained that in 1986, the then Mutawalli, Raheem Uddin, illegally leased out the Wakf land for agricultural purposes without permission from the Wakf Board. Subsequently, the lessee unlawfully sold the land in 1990, manipulated revenue records, and got their names entered in patta and pahani.
He emphasized that a Mutawalli is merely a caretaker appointed by the Wakf Board and has no authority to lease or alienate Wakf land without prior approval. In this case, not only was the land leased illegally, but it was also fraudulently sold and re-transacted among private parties.
Mr. Khan further pointed out that the Wakf Board remained inactive for several years. However, in 1998, the Anjuman-e-Islami Muslimeen Trust approached the district administration, after which an inquiry was conducted by the then RDO, who rightfully declared the land as Wakf property and removed the illegal entries of private individuals from revenue records.
He added that for the past three years, Muslims in Bhongir have been peacefully offering Eid Namaz at the said Eidgah, performing six Eid congregations without any disturbance. However, just 24 hours before Eid, certain private parties approached the Hon’ble High Court without making the Wakf Board a party and obtained a status quo order, following which the Superintendent of Police, Yadadri Bhuvanagiri District, advised Muslims not to offer Eid prayers citing the court order.
Mr. Khan clarified that a “status quo” order does not prohibit religious prayers. It merely restrains parties from altering the nature of the land or undertaking construction activities. The Hon’ble High Court has nowhere directed that Eid Namaz should be stopped.
He termed the sudden restriction on Eid prayers as unjustified, arbitrary, and a misinterpretation of the court’s order, which is hurting the religious sentiments of the Muslim community.
Amjed Ullah Khan demanded:
The Telangana Government must urgently approach the High Court for clarification/modification of the status quo order.
The Government must ensure protection of Wakf properties and prevent illegal encroachments.
The district administration and police must facilitate peaceful conduct of Eid Namaz at the traditional Eidgah in Bhongir.
He warned that denying Muslims their right to offer Eid Namaz despite no explicit restriction by the court is a serious violation of religious freedom.
“The Government must act immediately. Eid Namaz cannot be stopped on the basis of a misinterpreted order. Justice must be ensured and religious rights must be protected,” Mr. Khan asserted.
