Chicago area DUI lawyer Steven Fagan explains: Is drinking and driving always DUI? Is it always illegal in Illinois law?
DUI in Illinois means driving while under the influence of alcohol, under Illinois law found at 625 ILCS 5/11-501, and the public campaigns constantly say "don't drink and drive". Why? Fear. The fear is that if you drink enough, and that's the key, your judgement, your coordination, your sense of timing and distance, and your ability to react will be affected.
However, simply consuming alcohol and driving does not mean you've committed DUI, even if you've been arrested. Police officers receive training in administering field sobriety tests to help them determine whether you're impaired. Why? Because they can't be sure either. So they use these tests to help them determine whether the alcohol consumed may rise to the level of impairment. A breath test or chemical test is simply one more test that may suggest impairment of a driver.
In addition, there are many ways to be charged with DUI that have nothing to do with alcohol, such as illegal drugs, or even certain prescription medications, espescially when used together with alcohol.
