Kinwestiyon ni Senador Rodante Marcoleta ang Energy Regulatory Commission (ERC) kung bakit nilagyan ng 12% Value Added Tax o VAT ang singil sa kuryente, gayong nakasaad sa Republic Act No. 9136 o ang Electric Power Industry Reform Act of 2001 na dapat ay abot-kaya ang serbisyo ng kuryente.
Sa pagdinig ng Senado nitong Huwebes (Oktubre 23), iginiit ni Marcoleta ang Section 2, Paragraph B ng batas na nagsasabing "dapat masiguro ang kalidad, pagiging maasahan, seguridad, at pagiging abot-kaya ng suplay ng kuryente."
