Landlord's Right to Get Property Vacated
As a landlord, you have the legal right to get your property vacated from a tenant. In an important judgment (Ajay Arora vs. Bhavna Sharma), the Supreme Court made it clear that tenant eviction cases should be treated as urgent and decided quickly by the lower courts.
How the Legal Process Works:
First, the landlord must have a valid reason to ask the tenant to vacate the property (like non-payment of rent, misuse of the property, or end of the lease period).
The landlord must send a legal notice to the tenant, asking them to hand back the property.
If the tenant does not vacate even after the notice, the landlord can file a case in court under Section 5 of the Specific Relief Act to recover the property.
The case will follow the regular civil court procedure.
