There are four considerations when it comes to the specifics of spousal support:

#1 : Is there going to be alimony?
We can use a formula to get an idea of whether there will be alimony or not.
• 26% of the higher earner’s income – 58% of the lower earner’s income (if you have minor children).
• 27% of higher earner’s income – 50% of lower earner’s income (if you don’t have minor children).
If the formula yields a positive number, alimony is possible. If it is negative, there will probably not be any alimony. These formulas are not the law in Virginia; however, they are widely used and respected as useful starting points.

#2 : How much alimony will there be?
In Virginia, the amount of alimony is need-based. The needs of both the alimony receiver and payer are considered when determining an amount. The formulas from #1 can be helpful in determining the amount.

#3: Duration of the alimony
The third element of alimony is its duration. 50% of the length of the marriage is a typical starting place — again, this is a rule of thumb, not the law.

#4: Terms of modifiability
Lastly, the terms of modifiability in regard to alimony must be discussed in a Settlement Agreement. This refers to the circumstances in which spousal support may be modified. It’s crucial to get these terms nailed
down in order to avoid bumps in the road post-divorce.
