BCCI not a public authority under RTI Act, rules Central Information Commission

Описание: In a major legal development, the Central Information Commission has ruled that the Board of Control for Cricket in India is not a “public authority” under the Right to Information Act, 2005. The ruling means that the BCCI will not be required to disclose information under the RTI framework.

The order was passed by Information Commissioner P.R. Ramesh, bringing closure to a long-running legal dispute that began in 2018. Earlier, former Information Commissioner M. Sridhar Acharyulu had declared BCCI a public authority and directed it to appoint Public Information Officers. The cricket board later challenged that order before the Madras High Court.

In the latest verdict, the CIC observed that the BCCI is registered under the Tamil Nadu Societies Registration Act and was neither created under the Constitution nor established through parliamentary legislation. The Commission further noted that there was no deep government control over the cricket body and that it remained financially independent through revenue earned from media rights, sponsorships and ticket sales.

The ruling also clarified that tax exemptions and statutory benefits do not amount to “substantial financing” under the RTI Act. The decision is expected to reignite debate over transparency and accountability in Indian cricket administration.
