Everyone has an opinion about war with Iran.
But almost nobody is talking about the law.
So let’s separate politics from legal analysis.
Under U.S. law:
• The Constitution gives Congress — not the President — the power to declare war.
• Sustained hostilities generally require congressional authorization.
• Acting without it raises serious constitutional concerns and likely implicates the War Powers Resolution of 1973.
Under international law:
• The U.N. Charter permits force primarily in self-defense against an imminent or ongoing armed attack.
• Preventive or regime-change strikes typically don’t meet that standard.
• No U.N. Security Council authorization? That’s another major legal problem.
You can believe the strikes were necessary.
You can believe they were justified politically.
But political justification is not the same thing as legal authorization.
When you channel the facts through the law — the conclusion is clear.
