2 The Road Traffic Act 1988 is the main law that regulates drink driving in the UK.
You cannot drive or attempt to drive in the UK if you have been drinking and the alcohol concentration level is over a certain amount.
3 Drink drive limits
Strict drink-drive limits apply in England, Wales, and Northern Ireland.
The blood-alcohol level of 80 milligrammes of alcohol per 100 millilitres of blood.
4 In charge of a vehicle
Driving or attempting to drive whilst over the prescribed alcohol limit is punishable by law with fines, driving bans, and even imprisonment - depending on severity, damages and casualties if any.
5 An individual is charged with being drunk in charge of a motor vehicle if he or she is the one in charge of the said vehicle on a road or in another public place after having consumed alcohol in excess of the prescribed limit.
6 The defence, in this case, is for the accused to prove that there was no likelihood of him or her actually driving the vehicle, while the level of alcohol remained over the limit.
7 The term "being in charge" is not clearly outlined, thus there is plenty of room for interpretation, and it is advisable for the guilty party to seek proper assistance from a driving offence solicitor.
A lawyer will be able to show that there was no intention of driving and that the vehicle was simply used to rest, for example, while waiting for the alcohol level to drop.
8 Penalties for being in charge of a vehicle while unfit through drink:
3 months' imprisonment;
a maximum £2,500 fine;
possibly a driving ban.
9 The penalties for being in charge of a motor vehicle while unfit through drink are higher if damages to other vehicles occur, if bodily harm takes place or if passengers are injured or die as a result of the accident.
