This video, presented by Ms. S. Kirupalakshmi, focuses on the distinction between Lay-off and Retrenchment as defined under the Industrial Disputes Act, 1947, as part of Unit 2, Part 5 of the Industrial Laws curriculum.
The lecture details the two concepts:
1. Lay-off
Definition: Defined in Section 2, Sub-section (K), a lay-off occurs when an employer is temporarily unable to provide work to an employee.
Nature: It is a temporary cessation of work.
Reasons: This situation arises due to factors such as shortage of raw materials, power failure, lack of stock, breakdown of machinery, or natural calamities.
2. Retrenchment
Definition: Defined in Section 2, Sub-section (OO), retrenchment is the permanent termination of a workman's service by the employer.
Exclusions: It does not include voluntary retirement, retirement on superannuation (age), or termination due to ill health.
Reasons: The termination is for reasons other than punishment or disciplinary action, often due to the company's financial problems or the need to reduce production costs.
Key Difference
The essential difference is that a Lay-off is temporary, whereas Retrenchment is permanent.
