FAQ's asked by children in care proceedings: Vicky Preece, senior solicitor. Tel. 01494 790017
Transcript:
1. Why can't I live with my mum and dad at the moment?
The reason for this - is because your social worker is worried that you are not safe from harm. Why don't you ask your social worker to explain this more.
2. Why can't I see my mum and dad if I am living in care?
You will be able to meet your mum and dad while in foster care if this can be arranged safely. This is known as contact and most children in foster care are able to meet their parents. You will also be able to meet other people special to you - such as brothers and sisters, grandparents.
3. Will I be able to return home?
This will be decided by the court - and a court will try and return you home if that is safe for you.
If it is not safe, the court will try and place with you another family member or relative such as an uncle, aunt or grandparent. If that is not possible you many need to remain in foster care.
4. Who makes the decision about where I will live?
The decision about where you will live will be made by the judge- he will listen carefully to you social worker and your parents and he will also listen to your children's guardian and also give recommendations themselves.
The judge will then carefully consider all the information and make the best decision in your best interests.
5. Who is the children's guardian?
This is an adult appointed by the court - they will be the voice of the child. They are independent and do not work for social services. They will meet with you and find out your views about what should happen. They will also give the court independent recommendations.
6.Who is the children's solicitor?
This is a lawyer who will represent you and the children's guardian in court. If you have a good enough understanding of the courts proceedings and you don't agree with your guardian then the children's solicitor may represent you directly.
