Officer Cornelius lets Jebediah off with a warning, then learns the “new” moto car was stolen. He arrests Jebediah for motor vehicle theft and perjury based on Jebediah’s roadside claim that he just bought it. Can both charges stand? Here’s the rule: theft can proceed because the officer later confirmed the car was stolen and Jebediah lacked proof of ownership. Perjury fails because it requires a sworn statement under oath, and a roadside chat is not sworn testimony. A prosecutor could consider false reporting, but perjury is out.
