இந்திய தண்டனைச் சட்டம் (Indian Penal Code) இந்தியாவின் முக்கிய குற்றவியல் சட்ட தொகுப்பு ஆகும்.இது குற்றவியல் சட்டத்தின் அனைத்து வகையான அம்சங்களையும் கருத்தில் கொண்டு அமைக்கப்பட்டது.இது 1860ல் வரையப்பட்டு 1862ல் பிரித்தானிய ஆட்சியின் போது காலனித்துவ இந்தியாவில் அமலுக்கு வந்தது. இது மெக்காலே பிரபுவால் உருவாக்கப்பட்டது.

இந்திய தண்டனைச் சட்டத்தில் 23 அத்தியாயங்கள் 511சட்டப்பிரிவுகள் உள்ளது


Section 360 says that:If a person conveys another (irrespective of age) beyond the limits of India, without the consent of that person or any person authorised to give such consent,it is kidnapping from India

Case law:
Varadarajan v state of Madras

Section 361 says that:If a person takes or entices away a minor male under 16 years of age,or a minor female under 18 years of age or a person of unsound mind out of the lawful custody of a guardian, without the consent of such gaurdian, then he commits the offence of kidnapping from lawful guardianship.
