Summary Trial under the Code of Criminal Procedure, 1973

The Code of Criminal Procedure, 1973 (CrPC) provides for a summary trial of certain offences. These offences are listed in Section 260 of the CrPC. The summary trial is conducted in a simpler manner than the regular trial. It is intended to expedite the disposal of cases involving minor offences.

The following are the main features of the summary trial:

The summary trial is conducted by a Magistrate of the First Class.
The accused is not entitled to a jury trial.
The prosecution is not required to produce as many witnesses as it would in a regular trial.
The accused is not entitled to cross-examine all the witnesses produced by the prosecution.
The summary trial is concluded within a period of six months from the date of the first hearing.
