As a general rule, the petition does not “expire,” but if the petition is transferred to the National Visa Center, or NVC, for visa processing and there’s no further movement on the case it will eventually be terminated – typically within 2 years. If an I-130 petition is terminated by the NVC, the petitioner and beneficiary must start over by filing a new I-130.
