Broker Liability will Destroy Independent Truckers... & MOTUS Misses Mark

Описание: The trucking industry just changed — and most small carriers haven’t realized it yet. On May 14, 2026, the Supreme Court unanimously ruled in Montgomery v. Caribe Transport II, LLC that freight brokers can be sued for negligent carrier selection when a crash involves motor-vehicle safety. That means brokers no longer have a guaranteed federal-preemption shield in these lawsuits.

The result?
Many brokers now have a stronger legal incentive to protect themselves by choosing larger carriers with cleaner public records, deeper insurance, longer operating histories, and stronger safety documentation.

The broker industry warned the Supreme Court this would happen.

At the same time, FMCSA launched Motus, the new USDOT registration system replacing parts of URS.

But here’s the problem:

Motus is NOT a full FMCSA compliance dashboard.

It only handles:

USDOT registration
MC authority applications
Biennial updates
Business information changes
Account management

It does NOT replace:

SAFER
SMS scores
DataQs
A&I
Drug & Alcohol Clearinghouse
FMCSA Portal safety systems
UCR
IFTA
IRP
2290
State permit and fuel-tax systems

So despite all the hype, the trucking compliance stack is still fragmented across multiple systems and logins.
