Josh Shapiro and 22 states just stood up to Trump and told the highest court in the country to shut his plan down.

The Pennsylvania governor joined attorneys general from 22 states and the District of Columbia in a Monday filing at the Supreme Court, fighting to keep Trump's attack on mail voting frozen right where the lower courts left it. Their message was blunt: this order is an extraordinary threat to democracy, and it cannot be allowed to take effect months before millions of Americans start voting.

At the center of it is Trump's March executive order, which would hand the U.S. Postal Service unprecedented new power to refuse delivery of a ballot to anyone not on a federally approved list. Shapiro and the states called it exactly what it is, an unprecedented and legally indefensible ballot-interception scheme that would leave voters with disabilities and voters in rural areas most likely to be shut out.

The courts have already seen through it. In June, Judge Indira Talwani ruled that key parts of Trump's order were legally void for trampling the states' constitutional authority to run their own elections. A three-judge appeals panel backed her up. Now Trump's Justice Department is racing to the Supreme Court to get the block lifted before November, and Shapiro and the states are refusing to let that happen quietly.

They were not alone. Twenty-six former Republican and Democratic governors filed alongside them, reminding the justices that the Constitution hands elections to the states and to Congress, not to a president issuing orders by whim.

The Constitution is clear about who runs elections in this country, and it was never supposed to be one man in the White House deciding whose vote gets delivered.
