A winding up petition is a form of legal action taken by a creditor to forcibly close a company due to unpaid debts.
If the petition to liquidate a company is successful, a winding up order will be granted by the courts and the compulsory liquidation process will subsequently commence. The liquidation of the company will be made public knowledge to inform creditors to lodge their claims.
Received a winding up petition? If you have received a winding up petition, seek immediate support from a licensed insolvency practitioner. Once a winding up order is issued, you will have seven days to stop the winding up petition, resolve the winding up petition or contest the winding up petition.
What next? If your business is viable, negotiate a formal repayment plan with creditors through a Company Voluntary Arrangement (CVA) or enter company administration.
