Illegal Weapons in California: What You Can't Own (PC 16590)
California possesses some of the most stringent weapon laws in the United States, and many residents are unknowingly at risk of arrest for possessing items they believe are harmless collectibles. Under California Penal Code 16590, it is a crime to manufacture, sell, import, or simply possess a wide range of "generally prohibited weapons." While most gun owners understand that short-barreled rifles, sawed-off shotguns, and "undetectable" firearms (like those made with 3D printers) are banned, the law extends far beyond firearms. It includes seemingly innocuous items often found at swap meets or antique stores, such as cane swords, lipstick case knives, belt buckle knives, air gauge knives, and shurikens (throwing stars). Even possessing vintage metal military practice grenades or brass knuckles can lead to serious criminal charges.
A violation of PC 16590 is a "wobbler" offense, meaning prosecutors have the discretion to charge it as either a misdemeanor or a felony, with potential penalties reaching up to three years in jail. However, intent is a crucial element of the crime. To secure a conviction, the prosecution must prove that you knowingly possessed the item and understood it was capable of being used as a weapon. If you genuinely did not know that an antique walking cane concealed a blade, you may have a valid legal defense. If you are facing charges for possession of a prohibited weapon, it is critical to seek experienced legal counsel immediately to fight for a reduction or dismissal of charges.
