In this Ethics CLE, former OED attorney Emil J. Ali will provide a brief introduction to the USPTO's Office of Enrollment and Discipline (OED) and will explain how to ensure compliance with the USPTO Rules of Professional Conduct. Trademark attorneys are often unaware, until it is too late, that their conduct may not comport with the technical requirements, including regarding signatures, declarations, specimens, and more. Such violations may then implicate the USPTO’s ethical rules and lead to discipline. Based on his experience investigating misconduct within OED, and now representing practitioners before OED, Emil will provide best practices for how to avoid common pitfalls in trademark practice.

Presenter Bio:
Emil J. Ali is a partner at McCabe & Ali, LLP where he provides legal representation of patent and trademark attorneys in professional conduct investigations and enforcement actions initiated by the OED and state bars. Formerly at OED, Emil helped to promulgate the USPTO Rules of Professional Conduct and is a registered patent attorney. As the one of the only former OED attorneys actively representing clients before OED, his unique experience affords him a unique understanding of the regulation of IP professionals from multiple perspectives. Emil is also an adjunct professor at Lewis and Clark School of law and Vice Chair of the ABA-IPL Ethics and Professional Responsibility Committee.
