In nineteen ninety-one, journalist Nicholas Lemann published his history book The Promised Land: The Great Black Migration and How It Changed America. This book analyzed the migration of some five million Black people from the rural South to northern cities between nineteen forty and nineteen seventy, seen against the background of the federal government’s efforts to eliminate racial discrimination and poverty. When a figure in this book thought he’d been unfairly depicted, he sued the publisher in Haynes versus Alfred A. Knopf.

Lemann structured his narrative around the life of Ruby Lee Daniels, who grew up as a sharecropper in Mississippi. Daniels moved to Chicago in 1946. She was unmarried and had several children when she met Luther Haynes, another Mississippi transplant. Daniels and Haynes spent several years together, producing several children and eventually marrying. Their lives were always a struggle, with jobs, housing, and public aid regularly acquired and lost. Daniels complained that Haynes drank too much. She blamed this drinking for one of her son’s developmental problems. Eventually, Haynes divorced Daniels and married another woman with whom he’d been having an affair.

Haynes came off rather badly in Lemann’s portrayal, which covered his adultery, drinking, and loss of jobs.

Haynes sued Knopf for defamation and invasion of privacy. The district court granted Knopf summary judgment. Haynes appealed to the Seventh Circuit.
