Thank you for asking me “If I get Arrested in FL but I live out of State do I still have to come to Court?”
The answer is... “it depends”.
If you are taken into custody - meaning, you’re physically booked into a jail and are released on conditions - bond or otherwise - then you’re technically required to get permission from the Court to leave the jurisdiction (to go home) and you’re also obligated to return and appear in Court when summoned.
On the other hand, if you’re given a “paper arrest” (a PTA / NTA - or a promise / notice to appear) then no conditions of pretrial release exist and you don’t need anyone’s permission to travel out of the jurisdiction of the Court.
In FL any felony charge requires a physical booking, and so both your ability to travel and when you are required to appear are up to the Court, but this doesn’t hold true with misdemeanor offenses in FL.
For misdemeanors, if you hire #HaberPA then 99 out of 100 times I can keep you out of Court by filing a formal Motion to Proceed in Absentia. In support of this Motion, and in order to permit me to appear in your absence, I’ll prepare and email paperwork for you to print, have notarized and return to me.
I’ll then invoke discovery (meaning that I’ll demand to see all of the evidence in your case), I’ll inspect and levy any appropriate challenges to it’s admissibility and I’ll assert any defense that you may enjoy.
I’ll use all of my skill and experience to beat your case, I’ll take advantage of any law enforcement failure or loophole, and when it is all said and done, and if you wish, and assuming that you’re eligible then I’ll also seal or expunge your record, and you won’t to come to Court for that either.
