How Do Attorneys Determine the Value of Personal Injury Cases

Описание: There are different ways that lawyers assess the value of a case. There are appellate decisions that determine the value of a case and there are amounts that we as lawyers commonly feel are appropriate. My thought on what the right amount is for a case, if I’m in trial on a case, is however much I can get a jury to award this person, and however much the appellate court will sustain. That’s the value of the case. An insurance company can tell me that something is a $250,000 case day in and day out, but if I think I’m going to get in front of a jury and they’re going to award my client $2 million, and the appellate court can sustain $1.5 of that, that’s not a $250,000 case in my mind. That’s how I assess it. In order to assess a case that way, you have to be able to walk in there and assume you’re going to win. That’s a big assumption, but if you’ve been doing it enough years, and you’ve been as lucky as I have, I just assume that it’s going to happen. There is no one example. It’s case by case.
