17-A Guardianship or Advance Directives: What is Appropriate for Your Child?

Описание: As your child with special needs approaches adulthood, it may be time to determine whether guardianship is necessary. Parents are used to making legal and medical decisions for their child but, without guardianship, these powers will cease as of the child’s 18th birthday. Sometimes for a child with special needs turning 18, an Article 17-A Guardianship is appropriate.

Alternatively, If your child is able to make most medical/legal decisions on their own, but needs additional supports, then guardianship may not be appropriate but there are other legal documents to put in place. A power of attorney, health care proxy and a HIPAA authorization can ensure that you are able to have access to medical records and professionals and help with major decisions, especially in an emergency situation.
