Gaurav Gogoi Questions Procedure During Debate on Motion Seeking Removal of LS Speaker
Congress MP Gaurav Gogoi raised constitutional and procedural concerns in the Lok Sabha during the debate on a resolution seeking the removal of Speaker Om Birla.
Referring to a landmark Supreme Court of India judgment, Gogoi said the Speaker is expected to demonstrate independence, objectivity and absolute impartiality as the presiding officer of the House. He also cited Article 96 of the Constitution of India, arguing that the Speaker or Deputy Speaker should not preside over proceedings when a motion for their removal is under consideration.
Gogoi questioned how Jagdambika Pal was chosen to preside over the debate, stating that the House record does not indicate how the decision was taken. He also highlighted the absence of a Deputy Speaker, referencing Article 95 of the Constitution of India, which outlines who should act as Speaker in such circumstances.
Responding to the objections, Union Home Minister Amit Shah argued that the House cannot remain without a presiding authority and that parliamentary functioning must continue even during such motions.
Gogoi further accused the treasury benches of interrupting opposition members during debates and emphasized that the Speaker should act as the custodian of the rights of the entire House. He clarified that the resolution was not driven by personal animosity but by concerns over the preservation of parliamentary values.
