India does not have a national legislation that governs paternity leave yet. There came a bill called the Paternity Leave bill 2017. But this bill was given no immediate effect and thus till today, we see no concept of paternity leave existing in India. The task of taking care of the newborn child in the contemporary world should be considered as the task of both the parents. When maternity leave is considered fundamental we see no difference even in the concept of paternity leave.
