I am Quan, an IP Attorney and partner of KENFOX IP & Law Ofice. It is my great honor to share with you today a topic of great importance to Chinese businesses operating in Vietnam “Trademark Squatting in Vietnam: Risks and Strategies for Chinese Brand Owners”
As you know, Vietnam is a market full of potential with a rapidly growing economy. However, this market also poses many risks for Chinese businesses, especially in terms of brand infringement.
While specific statistical data is not available, we have recently observed an increase in inquiries regarding trademark disputes in Vietnam involving Chinese brands. This highlights the seriousness of the trademark infringement issue and its potential detrimental impact on businesses' reputation and revenue.
In this presentation, we will focus our discussion on the potential risks faced by Chinese brands in Vietnam, the latest amendments to Vietnam's IP law, landmark trademark infringement cases, and effective strategies to combat such practices. Together with me today is my colleague, Ms. Hong from KENFOX IP & Law Office, who will also share some parts of the presentation to you.

Now let’s move into the first part, namely, “Overview of China's investment situation in Vietnam”
China and Vietnam are experiencing a period of booming economic cooperation. Chinese investment is surging in Vietnam, with a nearly 70% increase compared to last year.
This increase in investment is transforming the landscape of Vietnam's economy. Chinese investment is no longer concentrated in just a few areas, but is spreading across the entire country, from the north to the south, and from major cities to industrial zones. This diversification is creating jobs and boosting local economies throughout Vietnam.
What's driving this investment boom? There are a couple of key factors. Firstly, many Chinese companies are looking to relocate their supply chains to countries with lower costs. Vietnam, with its skilled workforce and strategic location, is a perfect fit. Secondly, the ongoing trade tensions between the US and China are encouraging Chinese companies to diversify their investments.
The good news is that this investment boom is a win-win situation for both China and Vietnam. China is gaining access to new markets and lower production costs. Vietnam is experiencing significant economic growth and development. By working together, China and Vietnam are building a strong and interconnected business ecosystem that will benefit the entire region.
We talked about China's growing investment footprint in Vietnam, but let's look at the numbers!
In the first 11 months of 2023 alone, China has poured more than 3 billion USD into 632 new projects in Vietnam! That makes China the leading source of new projects in Vietnam.
But it's not just about quantity, it's also about quality. China is investing heavily in major economic zones throughout Vietnam, from Hanoi in the north to Ho Chi Minh City in the south.
This investment is spread across 42 different provinces and cities, showcasing the wide reach of China's commitment to Vietnam.
Overall, China ranks 6th out of 143 countries investing in Vietnam, with a staggering total investment capital exceeding 27 billion USD! These numbers are undeniable proof of Vietnam's growing importance in China's global investment strategy.
We've seen the impressive statistics behind China's investment boom in Vietnam. But what exactly are these Chinese companies investing in?
Let's take a closer look at some of the powerhouse projects driving this growth! The slide here showcases a range of Chinese investments in Vietnam, from solar energy to electric vehicles and beyond.
