How do you paint an detailed picture of your daily struggles in such a short period of time and give the judge the information he needs to approve your case. In other words, how do you avoid being VAGUE?
As I discuss in this video, there are TWO things you must keep in mind as you prepare for your hearing:
First you must describe your activities with specifics - avoid meaningless phrases like "not very much," "not too far" or "just a little."
Remember that the MAIN issue in your case has to do with your capacity to perform the duties of a job. (Not your ailment)
Your inability to lift more than 10 lbs. and walk more than 50 feet will reduce the number of potential jobs that you could do. Not having the ability to lift very much or to walk very far means nothing in a job capacity analysis.
Second, if your condition is not the same every day, you are better off choosing a "typical" day instead of saying "it depends." I tell my clients to think about a slightly below average day and describe that.
If the judge's question calls for a range (i.e, what's the most you can lift frequently and what's the most you can lift occasionally), understand that frequently means 2/3 of the day and occasionally means 1/3 of the day. If you could lift 50 lbs. once if your life depended on it, that is not a true representation of your capacity.
Finally, spend time with your attorney practicing. In my experience the first go round in my pre-hearing calls is usually very rough but after two or three practice runs, my clients usually catch on. And you can have notes in front of you to jog your memory.
Your testimony is evidence in your case so you want to take advantage of the opportunity to paint a word picture of your life to the judge. Prepare and avoid common mistakes and your chances at a win go up.
