Can you still file a claim for an auto accident, if you were driving without a license or under suspension? My name is Kenneth Berger. I practice law here in Columbia, South Carolina, and I made this video to answer that question for you.

Now, we don't encourage folks to drive unlicensed or under suspension, but if a car crash was someone else's fault – in other words, if you didn't contribute in any way to that collision, it really shouldn't matter that you were driving under suspension, at least not when it comes to your claim for any type of injury.

Now some folks think that filing a car accident claim is only going to get them in more trouble. The fact is if you got in a crash without a license or under suspension you might have already had to pay a fine or, heck, they might have even taken you to jail. But that doesn't mean you weren't hurt. And it doesn't mean you're not entitled to fair and full compensation because of some other driver's negligence or recklessness. Unless not having a license or driving under suspension contributed to the wreck in some way, you can still receive a fair outcome in the civil system. The civil system provides compensation.

Let me give you an example. Let's say you're sitting at a red light. In fact, you're trying to get to work, and another driver is texting and driving and crashes into the back of you. Now that can happen to anyone. It can happen to someone with a license or without a license. In those instances, you didn't do anything to contribute. You were just sitting there minding your own business, trying to get to work, and you should still be able to recover fair compensation for every harm and every loss you experienced.
