My name is Barry Doyle. I'm a lawyer in Skokie, practicing nursing home abuse and neglect work throughout the state of Illinois. In a nursing home abuse and neglect case, you not only have to prove that there was some bad outcome that occurred in the nursing home, but you also have to prove that it occurred due to substandard care. As part of your case, you are going to be required to establish that there was, in fact, substandard care.

There are a number of sources from which you can establish that substandard care occurred. One of those sources is the policies and procedures from the nursing home itself. Every nursing home has policy and procedures, and the nursing home is, in fact, required to provide care in accordance with those policies and procedures. These are things that we ask for as part of the pretrial investigation that we do as part of every nursing home abuse and neglect case.

Once those policies and procedures are received, then we review them carefully. These often lead us into other areas of investigation. But certainly when we're taking depositions of the nursing home staff, we often present them with the policies and procedures, go over the fact that they were trained on these policies and procedures, that the policies and procedures were readily available to them anytime they needed them, and that they were required to, in fact, provide care consistent with those policies and procedures.

Many policies and procedures are, in fact, things that fairly closely track the requirements of state and federal regulations. Other policies are fairly detailed to some of the real nitty gritty details as to how care should be provided. Either way, these are a really powerful tools for establishing that substandard care was provided to a nursing home resident, and this is something that we take advantage of in every nursing home abuse and neglect case.
