Judge SHOCKS Everyone: “There Was NO Probable Cause”

A tense courtroom hearing takes a dramatic turn as defense attorney challenges police testimony surrounding the arrest of Malcolm Tally in Detroit.

The hearing focused on whether officers had probable cause to arrest Tally after allegedly seeing a weapon-mounted light point in their direction. During cross-examination, the defense questioned the officers about the arrest, the firearm, the handcuffs, and whether they actually believed Tally intended to threaten them.

One officer acknowledged that he asked Tally to retrieve the firearm himself—while the defense argued this was inconsistent with the claim that officers believed they were facing an immediate threat.

The judge ultimately found there was no probable cause for the felonious-assault arrest and suppressed the breath-test evidence. The case was later dismissed without prejudice.

Watch the full courtroom exchange and hear exactly what the officers, defense attorney, and judge said.
