Описание: Pharma to Doctor Money Loophole. The Anti-Kickback Statute is a law preventing pharmaceutical companies from paying doctors to prescribe their medications. Group Purchasing Organizations (GPOs) have a 'Safe Harbor' from the Anti-Kickback Statute.

Therefore to circumvent the Anti-Kickback Statute, pharmaceutical companies can pay GPOs bonuses and those GPOs can then pay doctors bonuses for prescribing medications.

This approach is used for medications that are injections and infusions, which are administered in the doctors office, outpatient clinic or dialysis center.

These medication costs and associated bonus payments to providers do not show up in an employer's pharmacy claims, but rather are hidden in their medical claims.

These bonus payments totaled hundreds of thousands of dollars paid to individual physicians at a particular practice just for changing from one medication to another.

Potential solutions for this loophole include 1) doctors and physician practices simply refusing to take the money offered to them by GPOs or 2) having doctors disclose their payments to every patient who receives the medication in their practice.
