Datta Gade, the accused in the rape case at Swargate bus station in Pune, has been arrested and remanded in police custody until March 12. When presented in the Shivajinagar court, three lawyers argued on behalf of the accused, claiming the incident was a result of mutual consent and did not constitute rape. The defense lawyers argued that the young woman entered the bus voluntarily and the incident was consensual. They further stated that two days of police custody should suffice for the investigation. Speaking to the media, the lawyer reiterated the claim that the woman consented to the act, and the accused maintains it was not rape but consensual sex, citing the Supreme Court's stance on consent in such cases.
