SECOND DEGREE ASSAULT

In Colorado, people face second-degree assault charges for taking any of the following six actions:

1. Intentionally or recklessly causing an injury with a deadly weapon,

2. Intentionally hurting someone by suffocating or strangling,

3. Causing a serious injury while trying to cause a less serious injury,

4. Intentionally causing someone else to suffer a physical or mental impairment by drugging him/her without consent,

5. Intentionally hurting someone to prevent a police officer, firefighter, or EMT from working, or

6. Trying to harm an emergency responder by using bodily fluids

Under C.R.S. 18-3-203, second-degree assault is a felony. Depending on the circumstances of the case, penalties range from one year in prison to sixteen years in prison. The penalty will usually be reduced if the assault was done “in the heat of passion,” which means that the defendant acted without premeditation and more out of instinct.
