An interview with Texas State Rep. James Talarico was abruptly dropped from an episode of The Late Show with Stephen Colbert this week, following what Colbert called strict instructions from CBS leadership that Talarico's appearance would trigger the FCC's equal-time rule and that Colbert would be obligated to offer time to Talarico's opponents.
It's ignited confusion surrounding the century-old rule and the exemption granted to news programs, which has been extended to late-night talk shows since 2006. FCC chairman Brendan Carr has been more critical of equal-time exemptions, and his agency has already begun an unspecified "enforcement action" against ABC's "The View" for their own interview with Talarico.
AP politics reporter Meg Kinnard joins Michael Smerconish to explain the equal-time provision and the controversy surrounding the shifting understanding of its enforcement—and why the FCC could be targeting talk shows ahead of what is sure to be a fiery midterm election cycle.
