A new analysis by MS NOW and The Marshall Project, based on immigration records obtained by the Deportation Data Project, found that at least 500 children age three and younger have been detained by U.S. Immigration and Customs Enforcement since President Trump returned to the White House in 2025. On an average day, 25 babies and toddlers were held in immigration detention --- ten times more than during the final year of the Biden administration, when fewer than three young children were detained on an average day. Through an examination of detention data and interviews with families, pediatricians, child development experts, and attorneys, the investigation explores the impact on immigration detention on America’s youngest detainees. Parents described children becoming sick, going hungry, and showing signs of developmental regression during confinement that, in many cases, lasted longer than the 20-day limit established under the Flores Settlement Agreement, the landmark 1997 court settlement that set national standards for the treatment of children in immigration custody.
