Purpose: Allows a detained person (or someone acting on their behalf) to challenge the legality of their imprisonment.
Historical Roots: Originated in English common law, notably codified in the Magna Carta (1215) and reinforced by the Habeas Corpus Act of 1679. It’s also enshrined in the U.S. Constitution (Article I, Section 9), which states it can only be suspended in cases of rebellion or invasion when public safety requires it.
Applications: Used in criminal cases, immigration disputes, or civil matters (e.g., challenging custody of a child or mental health institutionalization). For example, a person detained without charges can file a habeas corpus petition to demand a court review.
Process: A petition is filed, the court reviews the detention’s legality, and if the detention is found unlawful, the person must be released.
