Who is Prohibited from Buying a Weapon in New Jersey? by Adam M. Lustberg
New Jersey gun laws impose strict rules on who may legally purchase, possess, or own firearms. Many people face serious consequences when they apply for a Firearms Purchaser Identification Card (FPIC) or a Permit to Purchase a Handgun and discover they are disqualified under New Jersey Statutes Section 2C:58-3. Age restrictions alone prevent anyone under 18 from receiving an FPIC and anyone under 21 from obtaining a handgun permit.

Gun ownership is also prohibited for individuals convicted of crimes, disorderly persons offenses involving domestic violence, or those subject to domestic violence restraining orders. The law further restricts applicants with substance abuse issues, controlled dangerous substances convictions, or prior unlawful possession of firearms. These rules often lead to permit denials and weapons offenses that may require immediate legal action.
New Jersey also enforces additional firearm bans under New Jersey Statutes Section 2C:39-7, which permanently prohibits possession of firearms or ammunition for individuals convicted of aggravated assault, kidnapping, robbery, and related offenses. Even attempts or conspiracies tied to these crimes can result in disqualification. Ammunition possession prohibition remains one of the state’s broader enforcement measures beyond federal standards.
The Extreme Risk Protective Order Act (ERPO), also known as the Red Flag Law, allows family members or law enforcement officers to petition the Superior Court of New Jersey for firearm restrictions. Courts may order seizure of weapons, revoke permits, and prevent purchasing or possessing firearms while the ERPO remains active.
The Firearms Applicant Registration System (FARS) requires applicants to submit materials through local police or the New Jersey State Police. This includes fingerprinting through IdentoGO, references, and mental health record consent. Applicants denied under these standards may seek review through a Superior Court petition under N.J.S.A. 2C:58-3(c).
